In evaluating a claim, the documented project plan as a whole, including the evaluation plan, should be submitted.

<h3>What should be included in an evaluation?</h3>
  • Use a focus group and/or jury consultant as necessary to assess your case's strengths and weaknesses, its financial worth, its potential for comparative negligence, and the most effective means of getting your point across to the defendants.
  • Know your audience before writing a settlement demand or presenting a settlement video. Who will see this material, and if they won't have it at least 15 days before the mediation or trial, there's no need in bothering.
  • With an offer to extend your deadline upon the defendants' request, if required, settlement requests should be time-limited.
  • If bureaucracy causes the defendants to lag, this will allow you to obtain the final say from them.

Hence, the entire documented project plan, including the evaluation strategy, must be provided in order to evaluate a claim.
