In a series of key decisions, the Supreme Court has significantly expanded its powers. Marbury v. Madison (1803) established the Supreme Court as the final arbiter of the Constitution, giving it the power to declare acts of Congress unconstitutional.

The Supreme Court has the power of judicial review to obey and prohibit violations of the Constitution. The Tenth Amendment gives states the power to do things not expressly mandated by the federal government.
