The US Constitution limits the power of the president as comander in chief by giving Congress the ability to declare war.

The President of the United States cannot declare war without Congressional approval. The President does have the ability to put troops in another country for 60 days. However, if he/she does not get approval for those troops to be there, they must be removed within 30 days. This ability to check the power of the president is part of the checks and balance system established in our constitution.

The Constitution of the United States has a text in which it actually limits the power of the President as Commander as Commander in Chief by granting the power to declare war to the American Congress as part of its own check and balance system on the Section 8 of Article 1.

March 1968: President Johnson halts bombing in Vietnam north of the 20th parallel.

November 1968: Republican Richard M. Nixon wins the U.S. presidential elections on the campaign promises to restore “law and order” and to end the draft.

December 1972: President Nixon orders the launch of the most intense air offense of the war in Operation Linebacker.
