The answer would be Murray v. Pearson. This was
a Maryland Court of Appeals choice
which create "the state has assumed the purpose of education in the law,
but has lost students of one race from the only passable provision made for it,
and exclude them exclusively because of their color." On January 15, 1936,
the court stated the lower court ruling which ordered the university
to directly mix its student population, and so shaped a legal example creating separation
in Maryland unlawful.
Their proposal specified the process by which a president could be declared "unable to discharge the powers and duties of his office", thereby making the vice president an acting president, and how the president could regain the powers of his office.
