The settlers who first entered to the unassigned lands of the state of Oklahoma before the Land Rush of 1889 were known as Sooners. Most of the Sooners were land surveyors, railroad employees and deputy marshals. They often crossed the territory at night and used to hide in the ditches to claim the land ahead of the legal settlers. The people who tried to occupy the land with the official start of the land run often found the lands were already occupied by the sooners. Litigation was used to settle the disputes between the Sooners and legitimated land run participants.
