Annie and Bart are coworkers. In fact, they share a cubicle wall. Recently, they were involved in a fender-bender in the company

parking lot. Each blames the other for the accident, and the two have stopped speaking. Would you advise them to try to settle their dispute through arbitration, mediation, or with a traditional lawsuit? Why?

The right answer to that question is mediation. Annie and Bart have to settle their dispute through mediation.  

 

EXPLANATION:  

Due to Annie and Bart are co-workers, arbitration and traditional lawsuit won’t be a solution. The arbitration will put the dispute into a high or serious level which might give a negative impact on the company where they work on. It is not good for the company’s reputation if the dispute of its co-workers is being solved by arbitration. The same with the arbitration, the traditional lawsuit won’t help because it harms the relationship between Annie and Bart as co-workers. The company’s reputation and name will be also in danger. The traditional lawsuit will harm everything.  

Thus, the applicable solution is mediation. As Annie and Bart are co-workers, who work in the same company, both of them have to maintain their professional relationship. They can solve the problems by mediation as the problem is not very serious or big. The mediation will keep the dispute at the level of a friend.  

Mediation is the procedure where Annie and Bart could discuss their dispute with the guidance of trained impartial third person or assistance who acts as the mediator. The mediator has to be patience and persistent person. He also has to own common sense. The mediator will mediate Annie and Bart as they try to find the solution while keeping the dispute as theirs.

Treating one another with hostility is not good for the atmosphere at work and it may have a negative effect on their productivity level as well.

Because they are coworkers, a traditional lawsuit would not be advisable as it would create farther dispute and the company's name and reputation would suffer. Arbitration may work but again, this would take the dispute to another level of importance, thus not being good for the company.

Mediation keeps the dispute at friends' level which is what both Annie and Bart are. The accident was not serious and they should rise above their pride and try to work things out in a peaceful and not accusatory manner. This would also show the other coworkers and the director that they take their jobs seriously and are not prepare to risk them because of some personal matters.
