This ability that the Supreme Court has which interprets the Constitution <u>is called judicial review (A).</u> <u />This ability is determines whether a law or action is constitutional or unconstitutional. The law, action, or decision is looked over by the Supreme Court before it is deemed constitutional or unconstitutional.

The Supreme Court's ability to interpret the Constitution is called Judicial review.

<u>Judicial review is proceeding that takes place in court and a judge reviews the lawfulness of a decision as well as an action that is made by any public body</u>. It can be viewed as a challenge to the method by which a decision was made without considering the rights and wrongs of the conclusion. A court that has the authority of judicial review may invalidate laws as well as actions of the government which are seen as incompatible with the higher authority and it also has the authority to invalidate an executive decision that violates the terms of the constitution.  

<u>The judicial review comes under a system of checks and balances. Two different legal systems which are common law and civil law, view judicial review differently</u>. Judges of common law as viewed as source of law who are capable of creating new legal principals and along with that they can also reject some of the legal principals which they see as invalid whereas in tradition of civil law, Judges as the ones who are seen as those who apply the law and have no power to create or destroy new principals.
