Yes, in the world of advanced cyber technology today, hacking on almost any device including smart phones is possible, with users containing classified information at high risk. Since this would be considered free speech, the U.S constitution is a little vague when relating any law or amendments to hacking, and under the first amendment, hacking is technically considered free speech. However, obviously in the modern US, hacking without permission is a crime, and sentences can vary from six months to even a few years depending on the significance of the hack.
