Because there was rivalries between African leaders and Europeans. The Europeans could easily take control by using force and violence.

In addition, 'the great schism' was a barrier that Constantine and pope were separated (both which they agreed on) due to different ethnicities, languages & culture.

The Slaughterhouse case in 1873 is notorious in the US history for severely limiting the 14th amendment. 

This case violated and mocked the 14th amendment, disregarading the Priviliges or Immunities Clause which states that “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States.”
