This term "Due Process" refers to a fair procedure. A fundamental, Constitutional Guarantee that all<u> legal proceedings will be open </u>and that one will be given notice of the proceedings. The Fifth Amendment declares that Due Process is one of many promises of protection given to the Citizens under the Bill of Rights. Therefore, it is not always sufficient for the government to act in accordance with whatever law there is. Citizens may also be empowered with the  government observe or allow fair procedures.
