As you may know, the use of pathos is an appeal to emotion that mainly tugs on the heart strings in order to have readers/audience members feel sorry for the writer/speaker so that they may be more easily persuaded.  That said, the line of the speech that seems to do this the most strongly is the first line:  “Friends and fellow citizens:  I stand before you tonight under indictment for the alleged crime of having voted at the last presidential election, without having a lawful right to vote.”  To state that a person is before you who is indicted can certainly lend to the possibility of feeling sorry for them.
