While in civil negligence, the prosecutor needs to only prove that the defendant was negligent, but criminal negligence is different. In criminal negligence, the prosecutor has to have definite proof that the defendant is guilty. The evidence has to be strong enough that there is no other explanation but the defendant is criminal negligence.
