In the year 1942, the United States was attacked by Japanese airplanes. In order to diffuse the situation and as a retailation to Japan, President Franklin Roosevelt ordered the evacuation of every Japanese person in America.

Mitsuye Endo, even though was an American citizen due to the number of years she has stayed in America, based in her Japanese origin, she was rounded up as well and taken to an isolation center.

Mitsuye Enzo filed an habeas corpus in United States district court in July 1942, stating the she was a loyal citizen and unlawfully detained. It was rejected and dismissed but she wrote a letter of appeal and the United States Surpreme Court took her case.

The elements in Endo's background that the court found the most important in ordering her release were:

a. Endo's citizenship as a LAW ABIDING United States Citizen despite her Japanese ancestry.

b. Endo's CONCEDED LOYALTY to the United States of America.

The United States Supreme Court stated that loyalty to the United States was in the mind and not in race, creed or colour.

Endo has an conceded loyalty to the United States because she was a law abiding citizen therefore, she was granted a release as protection against espionage or sabotage.
