The South African constitution protects citizens of South Africa from xenophobia. The South African constitution is set up to protect citizens from the very frequent xenophobic acts on South African streets and will go to the extent of bringing the NPA and courts on perpetrators of crimes with xenophobic intentions and are legally allowed to do so.

Xenophobia is the phobia of the foreigner or immigrant, whose manifestations can range from simple rejection to aggression and in some cases murders. In most cases, xenophobia is based on the feeling of protection of a nation, although sometimes it can also be linked to racism, or discrimination based on race.

  • Regardless of its ethical consideration, xenophobia can be a crime. Many States have criminalized racist and xenophobic behavior. The European Community approved, in September 2008, a law against racism and xenophobia, the member countries having a period of two years to adapt their legislation to this law.
