The founding fathers had mentioned the 39th clause of the Magna Carta, which was that the government can unjustly deprive any individual of “ life, liberty or property " and that no person would have legal action taken against them without the "lawful Judgment of his equals."  The Magna Carta had ensured that the king would not be above the law; just how the Founding Fathers wanted it here. They wanted the government to abide by the law and respect the rights of the citizens.

The Code of Hammurabi was one of the first legislative compilations of the civilized world, coming from Mesopotamia around the year 1700 BC.

Thus, there was the first documented case of retributive justice, in which people received consequences according to the actions they took.

This principle, synthesized in the phrase "an eye for an eye, a tooth for a tooth", laid the foundations of what we now know as justice, since it gave each action a logical result. Thus, today governments apply a commutative and corrective justice evolved from this ancient way of imparting justice, but continuing with the conception that every action has a necessary consequence.

Various other political reasons kept fueling the war between Poland, Spain, Russia, Moscow. In all these conflicts, Germany suffered the most. So, it couldn’t become a unified state. At the end, peace of Westphalia  recognized Europe as an organisation of equal independent states. France emerged as the strongest nation as Spain was hurt badly.
