Lincoln believed the South did not succeed or have actually left the Union. This was a legal position that would be born out in Texas vs. White 1869. Obviously they formed governments and made war on the Union.

The problem was Lincoln was assassinated and Johnson did not have Lincoln's political capital to fight the Radicals. They could never have challenged Lincoln with impeachment as they did Johnson.
