It is a rule known to be personal and with consideration on politics and not on the current rule. It is the opposite of judicial restraint. It is a term that the judges and the Supreme Court must take to mean the writings stated in the Constitution and the rulings to aid the personal ideas of the judges relating to the needs of the current culture.
