The decision to extradite a fugitive is made by the state governor. In some instances an appeal can be made on behalf of the fugitive to the supreme court. In other instances the fugitive may receive  repatriation. Repatriation is when someone is turned over to the law enforcement within their own country.

The US law recalls that Article VI of the Extradition Treaty provides that the request must be accompanied by "documents, statements or other information that describe the identity and probable whereabouts of the person sought."

Likewise, it must include texts of the criminal facts and the procedural history of the case, as well as texts of the legal provisions that typify the crime for which extradition is requested and the corresponding penalties.

In another paragraph, he notes that an extradition request could include multiple charges against a fugitive. The aforementioned documentation must accompany each criminal accusation.

<u><em>"If the State and Justice departments believe that the documentation accompanying the extradition request meets the requirements, a deputy prosecutor of the United States of the federal court of the judicial district where the fugitive is located will file an extradition request before a federal court of that country ",</em></u>
