In 1926, Edward Steichen purchased "Bird in Space" by Constantin <span>Brâncusi and tried to return to the US with the sculpture. New York customs declared that there was no import tax on art; however, the sculpture by Brancusi was not declared as "art", and categorized it domestic utensils and hospital supplies, taxing Steichen $200 in import costs. This was a significant moment in art history as the notions of aesthetics and art were challenged. Steichen challenged the judgement, and took the state to court. </span>
