A Chinese man named Ling Sing was murdered and an American named George Hall was convicted for the murder in 1853. There was a law in Section 394 of the Act pertaining to civil cases which states that 'no blacks, mulattoes, or Indians could testify against Whites'.

George Hall appealed the court decision to the Supreme Court, stating that the Chinese should be added to the group not allowed to testify against whites. The supreme court ruling agreed with him.
