In an effort to preserve the balance of power in Congress between slave and free states, the Missouri Compromise was passed in 1820 admitting Missouri as a slave state and Maine as a free state.

In the case of Dred Scott, he was brought by his owner to the north. When there, he sued for his freedom, claiming that now that they were in a free state, his owner did not have the right to still 'own' him, since it was illegal in the state. However, the judge ruled that property continued to stay as property regardless of where the property is located at.
