Both the Fifth and Fourteenth Amendments guarantee due process, which refers to the fair treatment to all individuals and respect of their legal rights. While the Fifth Amendment applies to the federal government, the Fourteenth Amendment applies to the states when it says: “nor shall any state deprive any person of life, liberty, or property, without due process of law.”
