Nieprawdą jest, że osoba przyjmowana na krótki, określony czas jest zwykle traktowana w kwestii warunków zatrudnienia mniej korzystnie niż osoba na etacie. Praca tymczasowa też wiąże się z wieloma przywilejami jak prawo do urlopu wypoczynkowego i zwolnienia chorobowego, a także okres składkowy liczący się do emerytury.

Zarówno „standardowa” umowa o pracę, jak i umowa o pracę tymczasową podlegają przepisom Kodeksu Pracy, są jednak oczywiście pewne różnice między tymi formami zatrudnienia. Przede wszystkim pracownik tymczasowy nie podpisuje umowy bezpośrednio z firmą, na której rzecz będzie wykonywał pracę, tak jak w przypadku zwykłej umowy – robi to z agencją pracy tymczasowej, która kieruje go do swojego klienta, czyli pracodawcy. Kolejną różnicą jest czas zatrudnienia – umowa o pracę tymczasową zawierana jest na czas określony. Inaczej wygląda też okres wypowiedzenia – jeżeli umowa zawarta jest na maksymalnie 2 tygodnie, okres wypowiedzenia wynosi 3 dni; gdy czas zatrudnienia jest dłuższy niż 2 tygodnie, wynosi on tydzień. Zwykła umowa o pracę może natomiast mieć nawet 3-miesięczny okres wypowiedzenia.

Dodatkowo, mimo że pracownikowi tymczasowemu przysługuje urlop, to na trochę innych zasadach. W przeciwieństwie do zwykłej umowy o pracę nie ma tu znaczenia, jaki jest staż pracy pracownika – za każdy przepracowany miesiąc otrzymuje on 2 dni urlopu (czyli 24 dni łącznie). Aby jednak otrzymać prawo do urlopu, pracownik musi być do dyspozycji pracodawcy przez minimum miesiąc.
