Cualquier persona en Colombia tiene el derecho constitucional de presentar una "tutela" ante cualquier tribunal del país, si siente que se violan sus derechos constitucionales. Esto podría suceder si no reciben atención médica adecuada, derechos educativos u otros de sus derechos socio-económicos-políticos garantizados en la constitución.

Una tutela puede tomar cualquier forma: escrita, oral, formal, informal. El objetivo es facilitar que las personas normales hagan valer sus derechos y obtengan protección de los tribunales. Cualquier tribunal tiene que aceptarlos y decidir si concederlos o denegarlos en poco tiempo. El Tribunal Constitucional los revisa y decide cuáles considerar en profundidad para las decisiones. Si se concede una tutela, la persona recibe una orden que puede devolver a su médico, proveedor de seguros, escuela, empleador u otra parte para que actúe de acuerdo con lo que dice la constitución y el tribunal.

The US Supreme Court's decision directly addressed case of Abington V. Schempp where students were being forced to participate in school-sponsored religious activities. The Supreme court held that the school was violating the establishment clause by just having this Bible reading program , even if it was voluntary.
