Mr. Mattingly, a well-to-do farmer, has a legal right to apply pesticides to his fruit trees. One year, he decided to hire a cro

p-dusting airplane to spread a pesticide on his orchard. An unexpected gust of wind blew the chemical onto a neighbor's beehives, killing all the bees. The neighbor sued Mattingly for the value of the 60 beehives. Mattingly argued that a good fruit farmer has to apply pesticides and that the crop duster had exercised extreme caution in applying the chemicals. How would you decide this case? Explain your answer

The decision of this case is going to be done through the use of the strict liability tort.

What is the strict liability tort?

This is the tort that makes a person to be resonsible for all damages or loss that may have happened due to their actions. This is regardless of culpability.

Even though the use of the pesticides was not aimed at destroying the neighbors beehives, it did. Therefore, Mattingly's actions has caused damages for his neigbors. He has to pay for damages.

How has the cabinet evolved over time?
padilas [110]

Many people help the president manage the business of the executive branch. His most important advisers are the members of the Cabinet. Over the years, the size of the Cabinet has changed. George Washington's first Cabinet had just four secretaries. There was one each for the departments of (1) Foreign Affairs (now known as the Department of State), (2) the Treasury, (3) War (now known as the Department of Defense), and (4) an Attorney General.

The modern Cabinet has fifteen heads of departments, as well as a number of other important officials. Secretaries of Agriculture, Labor, Health and Human Services, Housing and Urban Development, Transportation, Energy, Education, and Homeland Security are among some of the other Cabinet members.
