The previous section has briefly explained why judicial independence is important for maintaining judges' impartiality and the rule of law. This section now focuses on how judicial independence can be guaranteed in its fundamental aspects (external, internal, institutional and individual independence). Various mechanisms are possible, and a range of examples are provided to encourage debate and develop critical thinking.

Judicial independence is a multifaceted concept. There are different institutional, legal and operational arrangements that in abstracto are designed to ensure judicial independence, and they can work differently depending on the historical, political, legal and social context in which the judiciary operates. Therefore, there is not an ideal model of implementing judicial independence in the sense that one-size-fits-all. Judicial independence is - in more concrete terms - the result of a combination of different conditions, measures, checks and balances, that can vary from one country to another. Every country has to find its own balance.

In some countries, for example, judicial independence is basically secured through a self-governing body or council (composed mainly of judges) which is in charge of all the decisions concerning judges' recruitment/nomination, career, transfer and discipline. This occurs, for example, in France, Italy, Mongolia, Nigeria, Poland, Romania, Spain, and Ukraine. In other countries, such as Kenya, South Africa, India, Germany, Austria, Czech Republic, India, Kenya, South Africa, the United States, there is no equivalent body, and judicial independence is thereby secured through various other mechanisms. Therefore, what is deemed to be an essential measure in some countries may be not considered as such in others. This reveals rather different views on the institutional means needed to protect judicial independence.

The process of defining the institutional requirements of judicial independence has by no means come to an end. For example, the oldest institution of the British constitutional system, the office of Lord Chancellor, has been recently redesigned in an effort to bring about a clearer separation between the branches of the State, and to enhance the independence of the judiciary (see the UK Constitutional Reform Act, 2005; Shetreet and Turenne, 2013).

The protection of judicial independence is usually considered as including various aspects that operate on different levels: external and internal independence, and institutional and individual independence. External independence refers to the independence of the judiciary from the political branches (Executive and Legislative power), as well as any other nonjudicial actor. Although there must, of necessity, be some relations between the judiciary and the political powers (especially the Executive), as stated in the Commentary on the Bangalore Principles "such relations must not interfere with the judiciary's liberty in adjudicating individual disputes and in upholding the law and values of the Constitution" (2007, para. 26). Internal independence focuses on guarantees aimed at protecting individual judges from undue pressure from within the judiciary: from other judges and, above all, from high ranking judges. High ranking judges may, for example, exert supervising power over courts' administration (depending on the organization of the judicial system), but they must not - in any way - influence the substance of judges' decision-making.

Institutional independence pertains to the institutional and legal arrangements designed ex ante by the State to shield judges from undue pressure and influence. From this point of view, the most important factors concern the way in which judges are recruited, evaluated, and disciplined, the governance of the judiciary and courts' administration.

 In the 20th century the independence and decolonization movements in India.Israel and Nigeria were all very similar.All the countries had declared independence and decolonization through peace,mantaining structure,and culture groups through understandings with each other. They went about this way to avoid war and violence by trying to understand each other and just separate instead of trying to be united. They went through many obstacles in order to mantain the peace in order to get indepence.  

The independence and ecolonization movements in India,Israel, and Nigeria were similar in many ways, one way was through peace.In documents five and six it talks about ways the people of Israel and Nigeria had avoided violence and advocated peacefully for what they wanted. For instance, In document five it says " We appeal – in this very midst of the onslaught launched against us now months - to the Arab inhabitants of the State of Israel to preserve peace and participate in the upbuilding of the State on the basis of full and equal citizenship and due representation in all its provisional and permanent institutions. We extend our hand to all neighbouring states and their peoples in an offer of peace and good neighbourliness, ... " What is being said here is that the people of Israel even though war was brought upon them , they still advocate through peace. Another instance is in document 6 it says, " These parties negotiated with the British government over constitutional changes, but cooperation among them was the result of expediency rather than an emerging sense of national identity. Because of the essentially regional political alignments of the parties, the British government decided to impose a political solution for Nigeria based on a federally structured constitution." What the author is saying is that both sides of the orginizations advocated in a peaceful way in order to come to an understandable compromise in the end.

Another way the independence and decolonization movements in India,Israel, and Nigeria were similar in more ways than one , one of the similarties being maintaining structure. In documents one and twobasically show and tlk about seperation , mainly to mantain the strucutral order.For example, In document one it says, " His Majesty's Government view with favor the establishment in Palestine of a national home for the Jewish people, and will use their best endeavors to facilitate the achievement of this object, it being clearly understood that nothing shall be done which may prejudice the civil and religious rights of existing non-Jewish communities in Palestine, or the rights and political status enjoyed by Jews in any other country. " What is being said here is that through their letter asking for a safe place in order to mantain structure for them in order to still love peacefully.Another example is in document two, it shows Gandhi and Muhammad Ali Jinnah together who advocated for the seperation of a Muslim state to maintain peace and structure.  

Finally the last similarity of the independence and decolonization movements in India,Israel, and Nigeria in the 20th century is maintaining culture groups. In documents five and four it talks about and shows mainly Nigeria and India's culture groups. For example in document five it says, " On November 29, 1947, the General Assembly of United Nations passed a resolution calling for the establishment of a Jewish state in Eretz-Israel. The General Assembly required the inhabitants of Eretz-Israel to take such steps as were necessary on their part for the implementation of that resolution...by virtue of our natural and historic right and on the strength of the resolution of the United Nations General Assembly, hereby proclaim the establishment of the Jewish state in Eretz-Israel, to be known as the state of Israel. " This means by their historical culture right the before state of Israel had to change in order to mantain their culture. Another example is in document four which basically shows the different countries , where their located and their culture groups.

In conclusion, the similarties of the independent and decolonization movements in India,israel,and Nigeria in the 20th century were because of peaceful advocacies, maintaining structure, and maintaining cultural groups.All of the countries had fought without violence but advocated and maintained beliefs and structures that were really important to them.
