In order to operate the daycare legally the person would have to:

C) apply for a variance from the local zoning commission

A person can go to the Board or Committee of Adjustment to request a "variance" or deviation from the current zoning requirements. This will allow the person to use his or her home of residency for commercial activity without violating the current ordinance.

Although it would be nice to also have the consent of his or her neighbors, it is not the legal course of action. And a petition to the local government for a zoning change is not necessary since the entire zone is not being requested to be deemed as commercial, just the house alone.
