The  reasoning in the argument Tinker v Des Moines is that:

  • In Tinker v. Des Moines Independent Community School District, 393 U.S. 503  this was known to be a (1969) case where the Supreme Court was said to have ruled that public school officials are people who are not permitted to censor student expression only if they have the ability to make a reasonable forecast that the speech will lead to a kind of disrupt school activities or encroach on the rights of others.

Tinker had the stronger argument. This is because they were able to prove that the wearing of the band did not in any way disrupt school activities.

The dissent is one who have argued that the First Amendment is a law that do not in any way grant the right to show off any opinion at any time.
