In preventing medical malpractice lawsuits, pretrial screenings might be in use in a way to discourage cases that are not based on merit and save costs to both parties.

Medical malpractice is considered as an act of negligence which is usually committed by a medical provider. It is defined as something which a medical provider of ordinary skill would not have done.

So in order to prevent medical malpractice lawsuits, pretrial screenings is very much in use. This can be done by discouraging cases which are not based on merit and so this can save costs to both parties.

Hence, medical malpractice tends to occur when a medical provider fails to provide appropriate treatment to the patients.
