Bill of rights is the first draft provided for a system of checks and balances, including a strong executive branch, a representative legislature, and a federal judiciary.

The constitution was remarkable, but it was seriously flawed. For one, it did not contain specific statements or bills on individual rights. It specified what the government could do, but didn’t mention what it couldn’t do. Second, it wasn’t for everyone. “Subject Consent” applied only to wealthy white men.

The lack of a bill of rights proved to be an obstacle to ratification of the constitution by the states, and it took him four more years of heated debate before a new government could be formed. The Federalists opposed the inclusion of a Bill of Rights on the grounds that it was unnecessary. Anti-Federalists, fearful of a powerful centralized government, refused to support a constitution without a government.

The American people, recently liberated from the authoritarian British monarchy, have a strong commitment that the new government will not trample on their newfound freedoms of speech, press and religion, as well as their right to be free from baseless searches and seizures. The executive branch can declare Executive Orders, which are like proclamations that carry the force of law, but the judicial branch can declare those acts unconstitutional.

The judicial branch interprets laws, but the President nominates Supreme Court justices, court of appeals judges, and district court judges who make the evaluations.

The judicial branch interprets laws, but the Senate in the legislative branch confirms the President’s nominations for judicial positions, and Congress can impeach any of those judges and remove them from office.

It is important to keep these checks and balances because they are able to keep each other in line and working for the law not their pocketbooks.

If one branch was given too much power the entire system would not work and could possibly fall apart. It is set up this way for a reason and that reason is because it works and functions for the benefit of the people.
