The arguments for and against the death penalty

The worth of a human life.

Everyone values human life

The right to life.

The execution of the innocent.

Retaliation is a bad idea.

The most common argument in favor of capital punishment is that the threat of execution has a greater impact on criminal behavior than incarceration.

The death sentence acts as a deterrence as well as a type of permanent incapacitation, which serves to prevent future crime. "Execution of individuals who commit horrible murders may only dissuade one homicide every year.

The ability to create federal crimes and punish individuals who commit them was one of the most significant of these new powers. Opponents of the Constitution believed that with this new power, Congress would be able to employ brutal punishments as a tactic for oppressing the people. The Supreme Court ruled in Hudson v McMillian that a prisoner does not have to be seriously injured by prison guards to be subjected to an Eighth Amendment violation.
