President Adams appointed federalists to 16 new federal judgeships that were formed by the Judiciary Act of 1801 before he left office. The federalist judges Adams had chosen were known as midnight judges. Thomas Jefferson and other anti-federalists were concerned that a concentration of centralized power may result in the loss of individual and state liberties. They disliked Federalist monetary policies because they thought they benefited the wealthy.

The Judiciary Act of 1801 expanded federal jurisdiction, eliminated Supreme Court justices' circuit court duties, and created 16 federal circuit court judgeships.
