The 14th Amendment was approved by the Congress in 1866 and ratified in 1868. It was issued after the American Civil War to protect the rights of former slaves. It stablishes that <u>all who are born in the United States, no matter race and color, are citizens and in consequence they have the rights of citizenship</u>. The rights of life, liberty and property were guaranteed among others.

The Gitlow v. New York case was held in 1925 in the U.S Supreme Court. The latter ruled that the<em> </em><u><em>First Amendment</em></u>, which states the Federal Goverment can't prohibit the free exercise of religion or abridging the freedom of speech and press, among other things, a<u>pplied also to State goverments</u>. Therefore, the 14th Amendment's due process clause has to be held by the Federal and State goverments in the same standards in regulating speech.

The 14th Amendment made every man and woman equal under the law, despite their color or race. It granted liberty and civil rights to all american people. The Gitlow v. New York case made every state to protect and regulate the freedom of speech and press.
