Sy Bore has been receiving spam mail advertisements from adult-oriented web sites that contain pictures. Some of the pictures ar
e very similar to ones that have been termed obscene in his state, and the senders were punished at criminal law there. However, the senders of the pictures he is receiving in the spam mail are located in states other than Bore’s. Bore persuades the local prosecutor to bring charges against the senders based on the obscene nature of the pictures. At trial, the senders defend themselves by showing the material is not obscene in their home states. Can they still be convicted?
The reason behind this is that according to the state jurisdiction some rules have to be accomplished so that one person can be suited or judged as a cause of cybercrime were in one state his action is a crime and in the other is not. The rule behind this says that the minimum attachment required is a website registered in the state so it can be considered a crime. While sending an e-mail is not considered a crime, therefore they would go to jail.
