The case of Plessey vs. Ferguson created the "Separate but equal" doctrine which is why they said that segregation was constitutional. 

summary: a man that was 1/8th black entered a white only train car and got arrested. he said that segregation was unconstitutional and tried to fight it. he lost 7-1 majority.
