It was the formation of the two-party system. At the time those who share Hamilton’s views were called federalist while those who agreed with Jefferson were called democratic-republicans.  Like Hamilton, federalists believe in big government, centralized government while democratic-republicans who share Jefferson’s views believed in states’ rights and little interference from government.

The Judiciary Act of 1789 established the structure and rules for the court system in the US as created by the Constitution.

Marbury would have supported the Judiciary Act because it gave the Supreme Court the power to rule on the constitutionality of an issue and to handle disputes. Under this definition of the Court, Marbury believed he was able to take his case against Madison to the Court. Marbury was appointed at the last moments of John Adams' presidency and Madison heading the confirmation group for Congress denied Marbury's confirmation and therefore his position. He sued Madison claiming he constitutionally needed to confirm him. The Court heard the case but sided with Madison in stating they had no right to push through the confirmation.

Many historians might argue this point....   First modern war some consider was the Franco - Prussian war.  

The massive amount of technology used.  
Minnie balls, lever action guns, Gatling guns, trains, telegraph, air balloons.  

North had more people, machines, and factories.  They fought with one arm behind their back.  Yale or Harvard had the row club all four years of the Civil War.  

South had more mountains, but relied on other countries to supply their arms. Relied on cotton.  Thought English would join for that reason.  However, England found other countries to buy from.  

I suggest watching the Ken Burns Civil War videos.  Long but very informative.
