It was seen as an expression of popular sovereignty in France after the "Revolution of 1789". Through this Plebiscite, Napoleon was promoted from the first consul to the Consul for life in 1802. Although this position (Consul for life) of Napoleon was rejected by the Senate but the national plebiscite supported him to gain the same position and made him Emperor in 1804.

This small council of five served as a type of supreme court. There were two members of the ephors always with the kings on military campaigns to help keep an eye on the interests of the state.

Additionally, there was no established mechanism through which states could adjudicate conflicts. Many of the delegates to the Constitutional Convention understood that the Articles of Confederation would need to be supplanted entirely, not merely revised.

To this end, the delegates spent months debating and shaping the scope and contours of a new and more powerful federal government.^1
