Ernesto Miranda said his fifth amendment rights have been violated because he was not informed that anything he said could be used against him, his right to remain silent, and his right to an attorney to consult during interrogation. Had he been silent, he would not have confessed his crime. Had he had an attorney, he would have known about his fifth amendment rights.
