Though the Constitution of the country had already established the abolishing of slavery, the Southern states dominated by white supremacists brought forth the new laws that legalized the racial segregation of the people.

The origin of the name came from a white actor Thomas D. Rice's "blackface" character of Jim Crow in "Jump Jim Crow". Rice's character was used as a form of satirizing the populist police of Andrew Jackson. With the popularity of the character of "Jim Crow", the phrase began to represent the "negro" people.
