Even if a speech somehow hurt your feelings, that speech is still protected by the first amendment of united states under the free speech clause. The only exception is the speech that directly advocated for violence or a danger that targeted to certain group or individuals.

Explanation: Daniel's offensive speech is only a personal opinion and is protected under the first amendment. The Constitution protects your right to have free speech as long as it doesn't endanger anyone. While it is not eligible for a legal case, at least they both have the right to say whatever they want.
