The grieving party must know more than anything you understand that they are suffering and that you want to act the way you want from someone who has hurt you.

•     Action

Many people who do something dangerous to the relationship presume that time alone will heal the wound. All injuries must be actively treated. The injured party must know that you are doing repairs. This means investing time and energy to improve it again. That doesn't convey giving big or fancy cues. These are the small important things: spending quality time, listening to problems with understanding, helping others "process" their pain, and especially doing these things without defense, but with a sense of responsibility.

Actually, Clarence Darrow, one of the greatest attorneys in the history of the USA took an attorney when he was accused of a criminal offence. Therefore being "smart enough" is irrelevant; all defendants in all criminal prosecutions have a right to legal representation.
