The biggest problem with the regulation passed to regulate commerce was that the public ignored their rulings and their rules. It was difficult for everyone to agree on any one course of action. Article 1, Section 8, Clause 3 of the U.S. Constitution gives Congress the power “to regulate commerce with foreign nations, and among the states, and with the Indian. The U.S Congress usually uses the Commerce Clause to justify exercising legislative power over the activities of states and their citizens, which to significant and ongoing controversy with regards to the balance of power between the federal government and the states. Historically the Commerce Clause has both been seen as a grant of congressional authority and as a restriction on the regulatory authority of the States.
