The fundamental idea behind the Fourteenth Amendment secures the rights of citizenship to all Americans. Moreover, the Brown case talks about whether public institutions can lawfully be separated by race.

Separation of white children and Negro children in the public schools of a state merely on the basis of race, in accordance with state law which allows or requires such segregation, denying Negro children provide equal protection against the law guaranteed by the Fourteenth Amendment—although the physical facilities and other "real" factors of negro and white schools might be equal.

5. The "separate but equal" principle implemented in Plessy v. Ferguson, 163 U.S. 537, has no place in the area of public education.  

6. The cases are re-established to the agenda for further disagreement on detailed questions linking to the forms of the verdicts.
