Federalist vs Anti- Federalist were the first two big political parties.  

Those that wanted a big government and those that wanted a small government.  

Americans affiliate themselves to one side or another.  

Party system allows for one party to represent the majority of people.  

A third party emerges when enough people like a voice, and so stick with that one subject line.  Green party, tea party, no - nothing party, anti - slavery party....  

Third parties allow to join one political party, to help their voices heard.

Schenck v. United States was a Supreme Court case about the enforcement of the Espionage Act of 1917. I believe the case went straight to the Supreme Court and resulted in the Court's ruling that the criminal conviction of Schenck was in fact constitutional.
