One of the reasons that Justice Jackson gave for dissenting in the Korematsu case was that the military order punished Korematsu because of his race.

Korematsu was arrested and convicted because he violated the Civilian Exclusion Order number 34. The Supreme Court was split, 6-3. The Court decided that to protect from espionage during wartime outweighed Korematsu personal rights.  One of the justices that dissented, Robert H. Jackson considered that the military order was racist because Korematsu was a descendant of Japanese people.
