Tthe Supreme Court found that Sheppard didn't receive a fair trial. Freedom of expression should be given latitude, but not so broad as to divert a trial away from adjudicating both criminal & civil matters in an objective, calm,& solemn setting.

This was considered as a flaw because his action may have led to creating unnecessary pressure to the participants who happened to be his students as well.
