In the 1831 case, the Supreme Court said it did not have jurisdiction to rule in the case, because the Cherokee could not be considered an independent nation, but rather were a dependent nation within the United States.  But it left open the possibility of a "proper case with proper parties."  In <em>Worcester v. Georgia </em>(1852), that sort of case was presented and ruled in favor of the sovereignty of the Cherokee Nation.

The US flag code establishes that state flags can be flown at the same height as the US flag as long as the state flag is on a separate pole and the US flag is positioned to the right of the other flags from the building's perspective. State flags can also be flown underneath the US flag if they are on the same flagpole. However, state flags cannot be flown higher than the US flag on the same flagpole.
