I would imagine that this analogy stemmed from the fact that a fence normally serves as a border between two territories. With the patriots being one territory, and the loyalists being the other, one who wouldn't claim either would be left sitting on the metaphoric fence.
A territorial animal uses body language and noise production too ward off threats too there off spring of some other form of comfort to the animal. Say the gorilla when you step into it's territory its will either reveal its self or start a whooping call. If you still don't leave they will do a quick run up to you to check if your scared or not. If you do not move they will fight you over their territory
Citizens can have an initiative which can put your law on the ballot to be voted on which in the end with enough signatures or votes your law may become true and realized as a real law.
