On Sunday, September 9th, 1739 the British colony of South Carolina was shaken by a slave uprising that culminated with the death of sixty people. Led by an Angolan named Jemmy, a band of twenty slaves organized a rebellion on the banks of the Stono River. After breaking into Hutchinson’s store the band, now armed with guns, called for their liberty. As they marched, overseers were killed and reluctant slaves were forced to join the company. (Stono's rebellion was only one among the 250 rebellions documented in the Colonies and later in the southern United States)

The Constitution accepted most of the English common law as the starting point for American law. Situations still arise that involve rules laid down in cases decided more than 200 years ago. Each case decided by a common law court becomes a precedent, or guideline, for subsequent decisions involving similar disputes. These decisions are not binding on the legislature, which can pass laws to overrule unpopular court decisions. Unless these laws are determined to be unconstitutional by the Supreme Court, they preempt the common law precedent cases. Judges deciding cases are bound by the new law, rather than the precedent cases.</span>
