Article II lays down in detail the branches and the composition of the executive branch of the federal government of the United States. It lays down the processes of Presidential election, eligibility, responsibility, powers, and functions of the President. It also lays down the constitutional process and laws involved in the impeachment procedures of the President. Section 1 is concerned with the principle of Separation of Powers between the three branches of the Federal Government and lays down the several checks and balances that the branches employ over each other to maintain stability within the Federal Administration. Under this section, the Constitution vests the executive power in the hands of the President and states the composition and responsibilities of the electoral college, charged with the election of the President and the Vice President.

The Electoral College ensures fair representation of both houses of the Congress and has to ensure that the elections of the President and the Vice President are carried out in a most democratic manner. Section I also lays down the eligibility, powers, and duties of the President, and what measures are to be taken during a sudden vacancy of office. Section 2 of Article II lays out the executive powers of the President, establishing him as the head of the executive branch of the Federal Government, and the Commander in Chief of the United States’ Armed Forces. He is also vested with the capacity of granting amnesty or pardon to capital sentences awarded to any prisoner and has the right to be advised by any principal officer within the federal government. The President has the power to form his cabinet, comprising of his most trusted advisors, and he can enter into diplomatic treaties only after the ratification of the Senate by a two-thirds majority. Section 3 Lays out his powers with respect to addressing both houses of the Congress, and convening the Congress during any emergency, and commissioning diplomatic missions around the world.
